Lawyers that deal with this kind of stuff can get you a deal because that is what they do, and they are in court everyday so they know the D.A. and the Judge. Representing yourself or getting a court appointed lawyer never works out well. If you can't afford it, honestly you are likely going to just have to take what they give you. Honestly, I know for a fact that whatever advice I get is not going to help your situation by any great deal. You really need to be able to pay a reputable attorney who is in that courtroom everday if you want any sort of reduced sentence for this. You definitely are not going to get off the hook completely, and will likely be looking at some fines in the neighborhood of $2000, plus some mandatory alcohol classes. On top of that, you will probably end up with a restricted license for a year that will only allow you to drive to and from work. Don't request a supporting deposition when you plead not guilty as that equals paperwork for the Law Enforcement Officer. You piss him off, they will tell the DA to go after you with no breaks. Also, you may want to request an adjournment so that you can get a public defender. They may be able to help you free of charge (assuming you qualify based upon income). Don't expect to get away with murder like OJ with a Public Defender, but you may get it reduced down to a marijuana violation or something. Basically, a Public Defender won't do shit except maybe let you keep a conditional license. And yes...you can request adjournments due to no legal representation. He gets pulled over, the police suspect that he had been drinking, they get him to take a breath-a-lylzer, he blows over, so they read him his rights and take him to the station. They get to the station and they give him another breath-a-lylzer (as is the procedure). My neighbour ends up hiring a high priced lawyer to fit the charge, but when in court, it was the judge that noticed something. My neighbour was brought to the station at a particular time, as was documented, however, he wasn't given his second breath-a-lylzer test until 20 minutes after he was brought in. Procedure says that the second test must occur immediately after the guy comes into the station. The judge asked the cop who was testifying to account for these lost 20 minutes and for whatever reason, the cop wasn't able to. When the judge heard this, he threw the entire case out and my neighbour was let off, Scott free. I'm not a lawyer like Vert, but I think that if anything is not done by the books, it can be used as grounds to dismiss the entire case. Some bullshit started here a year or 2 back that if a New York State Trooper isn't wearing his hat when he pulls you over, you can get out of the ticket. Okay...I will speak from experience on this one... The couple lawyers that I called said $1500 just to represent and maybe get the fine reduced. They pretty much told me to grin an bear it and NEVER do it again!! My fine was less then 800 and I lost my license for 7 months, a lot cheaper then the lawyer. I also had to take an alcohol assessment and take a driving school class called group dynamics Plead No Contest rather then Guilty. This way no other charges stemming from the accident can be brought against you, after the fact. Mine was also a wreck, but only my own vehicle. I chose to chance it and not get an occupational license. This saved me from filling out an SR-21 ( high risk insurance) form, which in turn saved me on my insurance after the fact. But if you need the occupational license to work then you have to fill out the SR-21 before hand as proof of insurance(at least in WI) I bought a beater car with the minimum liability, which also saved on insurance. wotnartd 05-02-2008, 10:17 PM Okay...I will speak from experience on this one...
