I got a ticket two weeks ago on the way to school. I was following a sedan down a sidestreet, and we both stopped at a stop sign. She was going left, I was going right. I pulled to her right, pulled up alongside, and rolled out to see around her, and around the corner. Of course, I stopped past the white line, and the cop sitting right where I turned my head to look pulls me over and tickets me. I was extremely polite, had everything ready, "Morning Officer" and "Thank you, Officer" etc, and he still wrote me up as fast as he could. So not only is it chickenshit, but it's obviously a quota ticket (happened on the 26th). Citation is for failure to stop at a stop sign (total bullshit, I definitely stopped) and the fine is for $115.50. I'm going to contest by mail, so does anyone have any advice for me as far as going this route?

haha, 115 fn dollars. pointless to fight it, since you would pay for court costs.

if you're going to lose your license, then fight it.

I can't afford to not fight it. Not only can I not afford the $115, I can't afford the BIG insurance hike (I've had my license for two months). I don't think you pay court costs if you declare by mail, and if you win, you don't pay shit.

we dont have contest by mail. you go to court if you want to plea not guilty and the judge says do you want a trial by me or a trial by jury... trail by the judge will be 1/2 the fine on the ticket and 1/2 the points usually . the trial judge is not going to find you not guilty regardless of whatever you think you have to say that they haven't heard already. there is a slim chance you will be found not guilty by a jury... if you are under 30 I'm betting they will also find you guilty so you have to pay the fine plus court fees. sure it isn't like that everywhere... know it is in South Carolina.

In North Carolina I had a ticket for around 90 in a 60. The ticket said court appearance required. The trooper made a smart ass comment to me "You can't pay your way out of this one... court appearance required" I contacted a lawyer who was the ex-District Attorney in Hendersonville and he had it dropped to a non-moving violation... Lawyers are great... have to pay but in my experiences they get tickets dropped or reduced to nothing every time I have dealt with one.

In Washington you have three choices. You either 1) pay the ticket, or if you contest the ticket you have the choice to go to court to either 2) "explain the circumstances" or 3) confront the ticketing officer and present evidence on your behalf. Good fucking luck. :D

Your chances of fighting a ticket to a win by yourself in court are essentially zero. If you don't have a lawyer, you're almost guaranteed to lose. Best case is usually that the fine is reduced, but points are still added to your record, and your insurance rates will still go up.

The best defense is a good traffic attorney. I've never had to waste my time appearing in court since figuring this out, nor have I had a ticket stick. The downside is that it costs $350 a pop... but that's cheap when you consider what my tickets usually amount to and what the resulting insurance hike would be for the three years the ticket is on my record.

Like I said, good luck.

Mine was 90 in a 60. 6 points and no telling what the fine would have been.
Had to pay my attorney $400... turns into an improper equipment warning (non-moving violation)... no points... no other fees.

I was extremely polite, had everything ready...

Ready??? Do you mean you got to reach in the glove compartment while he was pulling you over. That' probably why he wrote you a ticket as well. I had a cop almost break my window because I did'nt ask firt before I reached for the glove box. You're supposed to keep your hands at 10 and 2 as well as not reach to roll down the window until he instucts you to. Cops get kinda jumpy/irratated when you make movements they don't instruct you to make or maybe that's just in D.C./Montgomery County and because I'm black. From your post it seems whites don't have to follow the rules to the letter.

and there's the turning point of a useful thread....

I've fought complete bs tickets that any lawyer could have had dropped with no success. Your best bet is to call or better yet go see the ticketing officer and kiss his ass.

We get a little bit of Lee way but not much. Last time I was stopped, I put my wallent on the dash, held up the dog so he could see her and then put my Hands on the steering wheel. Got a warning.

Ha, probably a good point. I could probably reach all around the car to put a gun together and the officer would be like, sir please pay attention and sign this ticket.

On more of a serious note, I'm not sure if its is more the area your in or the race you are in situations like that. I imagine your rate of movment through the cabin also has something to do with it.

I have had many traffic violations and am lucky enough to live in an area that allows you to just double pay the ticket and it is ammended to a non moving violation. No hassle with lawyers expect for when I get a ticket on the MO side. They dont like to play nice over there.

When he pulled me over, I had motor off (keys in ignition, though :(), window rolled down, hands on steering wheel. He asked me for license and registration, I reached for my wallet, took out my license, then told him the registration and insurance is in the glovebox, then reached for that. He took everything and immediately wrote me the ticket.

Cops can be major dicks when it comes to that time of the month. I got pulled over one time for passin in a no passing zone, and the cop already had the ticket written up before he got to my car. As for fighting it, might as well go to court, you stand a better chance of getting it reduced if you show up in person. Over here if you show up to court and the cop doesn't the ticket is thrown out, no questions asked.

My Driver's Ed teacher warned me about stuff like this. You stop behind that line then pull forward. You won't get many breaks when you get pulled over until you're over 30 and even then it's not common. The trick to not getting tickets is not getting pulled over and that means not doing stupid things behind the wheel where there is traffic enforcement.

I was pulled over by a Sherrif's deputy one night about 11 months ago. I was coming to work for a midnight to 8 AM shift and I came up on him from behind. I wasn't even going 5 MPH over the limit, but he was going dead nuts on 55. He was pacing me from in front. I followed him over 7 miles. I was going to try a different road off the highway, but pulled off too soon. When I pulled back onto the highway he stopped me and we had a chat. The Sherrif around here is for public safety. Once we had our talk and he made sure I wasn't wanted and had all my paperwork I went on my way.

last time I was pulled over, I knew I was nailed so I just stopped and waited for the cop to catch up to me.

He cut the fine in half and "forgot" to add some of the stuff to the ticket (like the construction zone I was in).

Cop followed me for a block and a half so he could pull me over in front of the high school to exemplify me. He's the school resource officer for my district.

Consider yourself lucky that all you got was a ticket. Stop signs are a one at a time thing. Not a two side by side thing. What I like to do, when someone can't wait to make their turn and they decide to pull up beside me and share my lane, is change my mind about turning left and turn right instead. I just cut the wheel to the right (aiming at them) and nail the gas. If I hit them (which I have) it is their fault since I was in front to start with and they went around me.

Yep twice in my daily driver (Saturn) I don't give a shit if my car gets screwed up and I came out with about $1200 in insurance money the first time and about $800 the second time. I don't do it for the money though just for the satisfaction of hitting some asshole who is in such a big hurry that they have to be a fucking idiot

i was turning right at a stop sign in the FC about a month ago when this bitch in a HUGE SUV pulls up next to me turning left, completely blocking my view. I pull up, so does she, and i pull up, again she does (like she cant see over me), until the point where im nearly in the fucking street. I roll down my window and say 'hey, I cant see shit!'. she says 'I'm turning left i have to pull up to see dumbass' (real sassy like). so the street we're turning on to has a turn lane for the street we're on and theres two people in that lane turning left onto the street we're on. (i hope you can picture that, its important). so at this point i'm pissed because i was pretty nice about saying 'hey, i can see shit!' in sort of a humorous manner. anyway, i say 'you dumb cunt (yes i said cunt), you can even turn left until both of those people out there in the turn lane turn left, what are you gonna do run them over?' and she rolls up her window and backs up. cunt. my point is sharing stop signs sucks, just wait.

what state do you live in?

this is standard practice in NJ.

if you're going straight at a stop you bear to the left, so people making right turns can go around you. if you are making a left you also bear to the left. it's legal to make right turns on a red light in NJ, so doing otherwise would hold up legitimate traffic.

here in wyoming where stoplights are few and far between, we do the same thing at four and three way stop signs.

But, out of staters will get pulled over if they don't stop behind the white line, which it seems was the whole issue in the first place.
