2ndGen.Rocket 02-05-2006, 03:24 PM So as some of you know I live among 2nd and 3rd year law students, as most of my friends decided to go to law school. Well, on Friday night we threw an ice luge party, with a couple of kegs. Wake Forest Law school paid for the party actually, as long as we threw it at our houses. Long story short, the cops show up at about 11pm.
The party was going on behind my friends house, which is right next door to my house. Our backyards are connected, and there were a bunch of people in my house as well. However, the cops showed up at the front door of his house. At this point, there was at the most 50 people in the backyard and the party was completely under control. I couldn't even hear what was going on outside from inside my house, and I'm right next door.
The cops show up and tell him that it is too loud. First off, it wasn't. I've dealt with this extensively and know when a party is loud. This wasn't, and the cop even said right off the bat that no one had called to complain. So, my friend tells him that he will turn the music off (which he didn't even have to do). At this point, he goes to close the door and the cop throws his foot inside of it, puts his hand on my friends chest, and shoves his way in the house. He wasn't invited in, he didn't have a warrant, and there was no probable cause for underage drinking.
The cop told my friend to get everyone out of here in 20 minutes or he will call ALE. ALE is the local Alcohol Law Enforcement agency. We laughed at this notion, and told him to go ahead and do that. I think the youngest person at our party was 23 years old, so we would have thoroughly enjoyed watching these assholes waste their night checking everyone's ID.
So now, these prick cops who have no reason to be there because no laws are being broken, decide to step over the line. They walk up to my friend and throw handcuffs on him, and tell him that he's under arrest. My friend turns around and tells the guy that he has no right to do what he is doing, there is no grouns for arrest, and that he better take them off. My other friend who lives in that house asked what the hell is going on, and they throw cuffs on him as well.
After throwing them in the car, the cops start talking shit to them. They put the handcuffs on one friend so tight that it is tearing the skin off of his wrists. He keeps asking them to loosen them because they are hurting his arms. They refuse. Eventually, they have to take him to the hospital because they fucked his wrists up so bad. After the cops brought him back from the hospital, they continued to talk shit about how he's going to have to pay that bill and everything.
My other friend was brought in front of the magistrate, where the arresting officer proceeded to lie his ass off about what happened. He told the magistrate that there was an out of control party with over 200 people at it. First of all like I said before, there was maybe 50 people there. 200 people would have taken up our entire backyard, and there would have been cars parked around the entire fucking block. As he said this, my friend made sure to tell him that he was full of shit. The cop once again threatened him by saying "I hope your friends have $2000 to bail you out, or else you're going to be here for a while". He also repeatedly told my friend to "keep his mouth shut or else he's going to regret it". Knowing full well that the officer can't do shit, my friend let him know just how big of a mistake he is making.
I called the Magistrate to find out how I can go pick them up. After 3 separate instances of the Magistrate and police department telling me that they don't know where they are, they finally say that someone sober can come get him. I sent a whole car of sober people that I know since I was too drunk to pull it off. Once the people arrived there, they were asked at the party. After saying yes, the officers refused to release one of my friends to them.
Now, it doesn't matter if they were in fucking Jamaica that evening. They were sober, of sound mind and body, and fully capable of getting my friend out. After them being refused, I got on the phone and pitched a fucking fit. After threatening the shit out of the lady at the front desk, they finally let him go.
It's now 4am, and I still have one friend in jail. I am pretty much dead sober at this point, so I get this girl I know to drive me there. The police made me wait 2 and a half hours before releasing my friend. They claimed that 4 separate people had to clear him through before he could go.
Now, here is another fucked up part. They originally came there and claimed to arrest them for a noise violation (which by the way is worthy of a warning and a ticket at best). However, on their forms it says they were arrested for "shouting loudly and cursing as to disturb the otherwise peaceful blah blah blah blah". No one started shouting or cursing until they were cuffed and brought away. So how exactly can you claim to arrest someone for something that they did after you arrested them? And since when is swearing illegal?
The police did not read anyone their miranda rights. They had no reason to arrest anyone. They didn't even have a reason to be at our houses. Basically, they realized this, realized they just got played by people who are more intelligent, and then got pissed off about it. Apparently what they didn't realize is that they arrested a couple of law students at a law school party. Now they have some serious, serious, serious shit on their hands. They handled the entire situation in the worst possible manner, and did so with some of the worst people to do it with. This is going to leave one problem now. After getting these guys either fired or reprimanded, there is the possibility that they are going to fuck with us all the time. So what would you do?
And sorry that shit was so long
Your party got screwed up..... Your friends went to jail.... and shit hasn't been done to the cops..... I'm having trouble applying the thread title here.
rodney87 02-05-2006, 05:21 PM wow, thats fucked. It will make for one hell of a class project thought. Of coarse it will be the cops word against 50 college kids, and they almost always tend to listen to the cop, law students or not. I'm guessing the best bet would be to point out so many violations and threats of other lawsuits for failure to protect and serve that the judge has no choice but to punish the cops.

The fact that the Winston-Salem PD is about to have a multitude of lawyers on their ass for harassment.

Exactly. Which sounds great, but like I said I also don't want those guys harassing the shit out of us for the rest of the year. If all works out well they will just leave us alone, but knowing the mentality of some of these guys, they like to band together and fuck with people.
rodney87 02-05-2006, 05:54 PM ^^ Can you get a TRO on a cop? I'm curious
aznpoopy 02-05-2006, 09:48 PM good question. imo the most reasonable answer would be...
yes, in terms of the cop as a person.
probably no, in his official capacity as an officer.
still, you guys should fight it. civil rights and all that good stuff.
then you should move. seriously though, good luck with whatever goes down.
Savington 02-05-2006, 11:02 PM Sue everything.
I can offer you my protection services....
2ndGen.Rocket 02-05-2006, 11:33 PM no i don't think anyone could get a restraining order against a cop while he is on duty. While he is off duty and in general public, probably.

Yea, but you can sue them if they harass you... Judges don't like cops harassing people either.

Only required when the suspect is being questioned. Don't your law school buddies know that? ;)
But good luck. You guys have a tough descision on your hands.

True, which is what is about to happen
2ndGen.Rocket 02-06-2006, 07:34 AM it's not worth it....they wanted to bust up your party, and they did
you will have more parties in the future, life will go on
I'm not going to let cops get away with abusing their power and harassing people who aren't causing problems, aren't bothering anyone, and who never get in trouble.
Plus, I couldn't ever miss the opportunity to take down some little dicked GED grad with a badge who thinks he's a tough ass.

I didn't know that, but then again I'm not in law school.
And thanks

In Canada, most cities require at least a university degree from all applicants.
Even so, there are a few dumbass cops that make the rest look bad. Education is no guarantee of character...
2ndGen.Rocket 02-06-2006, 10:16 PM True, but it also gives some of these guys space between highschool and policework to realize there is a different life. NYC started requiring all police to have at least a 2 year degree before being allowed to join the force, and it cut down on the corruption quite a bit. It lets these guys get of highschool, go to community college, work a shitty job, date a shitty girl who didn't leave the area, and realize that they are no longer the shit before they are given a badge and a gun.
JPAccord 02-06-2006, 10:30 PM I hate cops, the only thing I see that is worthy of being arrested for is the language. It is illegal to use profanity in public, at least to someone, but then again, that was after they were cuffed. A friend of mine called the clerk at the gas station a bitch once, she wouldn't return my debit card until the cops got there. We got cuffed and had to sort the whole thing out and sign a trespassing notice that we weren't allowed back at the gas station again. I hate police, they're always there to bust us for some stupid shit, but when something big happens, they can never help.
2ndGen.Rocket 02-06-2006, 10:38 PM They were actually on private property while they were cursing, as it was within the confines of their home and their back porch.
JPAccord 02-07-2006, 12:57 AM oh well then scratch that. I think the charge is public disorderly conduct?
