Anyways.. I hang out with the local racers, (not ricers) - we sometimes do illeagal things and frequently get them on film.

About 2 weeks ago we did some stuff out in the middle of nowhere, got it on tape. The other day we filmed me going 300km/h on the freeway (racing a crotchrocket) at about 4AM... Noone was hurt, injured, no property was damaged an no negative things happened (or ever have). We'd all live happily ever after and watch them on youtube ideally.

Unfortunatly, the person that does the filming got pulled over last night and somehow the car gets searched, and they WATCH THE GODDAMN TAPE.

I don't think that there are any dates on it but I don't live in a huge city and they CERTAINLY knew what kind of car it was and I'm sure my face has been captured on tape. I'm not sure but it's probable that my license plate was on the tape as well. The car is in my dad's name, and I've discussed it with him and he won't say anything dumb if he's questioned. I'm storing the car for winter now... Should I be going to see a lawyer in the morning?

wait. wait and see if they try any shit. Wait and see if they can even do anything with it. No dates and no witness's makes it difficult to prove. You can just as easily say that you guys made the race up on your computer from a race you found online then saved it to the camera to make your car seem faster.

search was for contraband. Going fast speed on film isnt. Since property isnt evidence, your friend must still have it.

Cops are like religious folks. They cant think for themselves. unless they view you as evil, consider yourself as 'ignored' on highway.

They were pulled over and searched because someone else in the group that they were following got pulled over and RAN FROM THE COPS. Why the hell they did I have no idea at this point. So my friends were looking for the idiots that ran, and got pulled over by a different police vehicle that had been in the area because they thought they were running too. I have no idea how the hell the tape gets involved, he said he had hid it in the vehicle but they searched the vehicle and found it, put it into his camera and watched the tape. It all sounds too impossible to be true, unfortunatly it isn't.

Did the cops do anything else besides take the tape? Did your friend get a ticket? If not, I don't think you have much to worry about. Unless they are trying to crack down on those types of activities, they probably won't spend the time or money to track you down and arrest you.

I wouldn't worry about it. They probably intended to use it as evidence against the person that ran. Since that wasn't you, I'd say you're fine. Most municipalities have limits to how long they can charge you with a vehicular crime. If you do actually get charged, any good lawyer could most likely get that dismissed on a number of issues. I'm moving this to the sex and relationships section so only members can read.

IIRC in Canada the cops have to actually see you committing the offense. You can't ticket the owner of a vehicle for the actions of another person driving that vehicle, especially if the actions weren't witnessed first-hand. That's why several provinces have had to remove their photo radar; it violates that principle. I think only BC has em now, and they're fighting tooth and claw in appeal after appeal to keep 'em.

Furthermore, police departments have a limited budget; they'll investigate things based on priority. Is stunting and streetracing a big problem there? If so, they may follow up on some of the vehicles or persons observed on the tape. If not, they have bigger fish to fry, like meth dealers and the Rock Machine gunning down HA members, etc. tracking down the owner of a car observed on an undated tape, investigating to determine who may have been driving the car when the actions were filmed, and putting together a case to prosecute that person only makes sense if the actions being undertaken were something commonly putting other members of the public at risk.

In other words, is it worth their time to do all the work to charge you? And have the charges stick? Unlikely on both counts.

I spoke with a lawyer today and manntis, heh, you hit the nail on the head. He basically told me exactly what you did.. he said don't even worry about it, there's nothing I can be charged with and even if there was, they wouldn't bother... They'll probably watch the tape a few times in the lunchroom at the police station for shits and giggles but they are probably not going to do anything about it, they have far bigger things to deal with.

When I posted this last night I was still in the "oh shit" stage, but I'm pretty sure I'm fine. I'm throwing a different set of wheels on the car just so it looks a little different, and it's not coming out of the garage for a few days, but I really doubt I have anything to worry about.

YouTube video prompts cops to accuse 2 teens

A pair of Winnipeg teens is facing charges following a landmark police investigation into street races that were captured on video and brazenly uploaded to youtube.com.

It is the first time city police have charged a person, let alone two, in connection with actions in an Internet video.

The five-minute clip -- captured on video by a passenger -- shows cars racing at high speeds on recognizable streets in Winnipeg. The clip has since been removed from the popular site where people can post homemade video.

Police traffic unit Sgt. Barbara Tobin said the teens are charged with dangerous operation of a motor vehicle (a Criminal Code offence), and three Highway Traffic Act offences -- racing with another vehicle, imprudent driving and careless driving.

"To the drivers that engage in this type of behaviour we will use whatever means at our disposal to proceed with charges," Tobin said.

"It was the first time we had ever utilized footage from the Internet. We looked to find out if there were ever any precedents on that, which we didn't find."

Mark De Leon, the alleged driver, and Mathew Zigue, his alleged passenger and cameraman, are slated to appear in court in January.

While De Leon declined comment yesterday, his alleged sidekick was surprised charges had been laid after learning about them from a Sun reporter.

In one scene in the video, a car races at high speed against a dark-coloured Honda Civic, at one point passing through a school zone near Tec-Voc High School in the West End.

The car also does two sprints. One scene shows the speedometer reaching 120 km/h (74.5 mph).

CAA Manitoba president Mike Mager said the "reckless" actions in the video could have injured or killed someone.

"I'm glad the police followed up on it and they've taken steps to charge the individuals. It is a deterrent and they won't do it in the future," Mager said.

The edited footage was uploaded to YouTube in June and deleted after the link and stinging comments by two people in the local automotive industry were published in the Sun in August.

Two names appeared at the end of the homemade video, and viewers got a glimpse of the driver's face and licence plate.

In August, University of Manitoba law Prof. David Deutscher said the Internet video may not be admissible as evidence in court.

"The usual test for the admission of photo or video evidence is that you have to have someone there that says, 'This video accurately depicts what took place,'" he said.

they are apparently doing an investigation - there was even a special on the news, I got to be a TV star! lol... but I don't see how they can press charges against me anyways, they'll never stick according to my lawyer.

There's no witnesses aside from my passanger and the video camera, and no proof that the whole thing wasn't staged w/ a doctored speedo and etc, I mean who's car can go 300 anyways! :D.

Also, in canada, they need to prove WHEN it happened, and that's damn near impossible.
