That case is COMPLETE b.s. I can't even believe they have to sue over that. Only an IDIOT would even defend that case in court. 1) The woman had power of attorney b/c the guy was obviously senile 2) The contract isn’t just voidable, the dude obviously doesn’t have capacity 3) the contract is obviously unconsciounable 4) That is common law, not just state law 5) They need to be suing under a tort instead

I can't believe they'd let it go to court - a dealership of that size can't afford that sort of bad press...

Are they going to sue the toyota dealership for selling him a toyota also?

Obviously they took advantage of him, but I didn't see any code of law in that article that was broken.

If I were the judge, I would simply revoke his license. If you aren't coherent enough to realize that you're getting screwed out of $14,000, you should not be able to pilot any car, let alone a fucking SUV.

courts will kill contracts if they find the terms to be unconscionable. there's a reason they said 'unconscionable' in the article. its a legal term. coincidentally, my contracts exam is on monday.

Uniform Commercial Code 2-302:Unconscionable Contract or Clause

(1) If the court as a matter of law finds the contract or any clause of the contract to have been unconscionable at the time it was made the court may refuse to enforce the contract, or it may enforce the remainder of the contract without the unconscionable cluase, or it may so limit the application of any unconscionable clause as to avoid any unconscionable result.
