Viewer sickened by 'Fear Factor' sues for $2.5 mil

January 7, 2005

CLEVELAND -- A viewer is suing NBC for $2.5 million, contending that he threw up because he saw a ''Fear Factor'' episode in which contestants ate rats mixed in a blender.

Austin Aitken said he watches ''Fear Factor'' often and had no problem with past installments where the reality show's participants ate worms and insects in pursuit of a $50,000 prize -- but eating rats went ''too far.''

''It's barbaric, some of the things they ask these individuals to do,'' Aitken said Thursday.

Aitken's handwritten lawsuit contends the rat-eating made his blood pressure rise, resulting in dizziness and vomiting. Because he was disoriented he ran into a doorway, ''causing suffering, injury and great pain.''

Asked why he didn't shut off his television, Aitken said he couldn't do it quickly enough.

NBC responded with this statement: ''We believe that the claim is completely without merit.''

he could not get up fast enough to change the chanel fast enough because he was trying to figure out a way to sue someone for some money!!!!! So does anyone know if the dumbass won the case or if it even went any further thatn that? It says in the artical that the guys blood presure rised made him dizzy and in a vomiting stage that caused him to run into a doorway...I dont think this guy is very bright anyway.

When people start winning stupid cases, it just encourages other people to sue for anything, which is gonna kill our judical system, cause it'll back up the courts... stupid people....

Wanna see stupid cases, I'll send you a copy of the paper from up here. They have entire law firms devoted solely to dog bites. DOG BITES! I'm sorry, but if a dog bites me and I gotta get stitches, I more than likely did something to the dog I shouldn't have. GG Cornell for throwing out tens of thousands of POS ambulance chasers per year.
