Not sure if that will work. I blew the Breathalyzer AND gave a blood sample. So they got me for driving under the influence of my prescription medication (Klonopin) and alcohol.

Fuck it. Plead not guilty. Absolute worst case scenario: Judge gets pissed you took up his time and you get the max. Best case: It gets dismissed all together. Probable outcome: You get a plea bargain so they don't need to have a grand jury indict you and go through a trial etc. Plea bargain may let you keep your license or face a very low limit suspension.

My suggestion: Before you go to court take A) an alcohol abuse class (get that shit in writing/certificate of completion) and B) take a Driver Improvement course (should be about $50 and it's like an 8 hour class on saturday), also get the certificate of completion. (I say these two courses because you will probably be ordered to take them anyway.. plus the driver's improvement one will give you positive points towards your driving record/liscense only if taken voluntarily, as in NOT court ordered)

Present both these things to the Judge, apologize, admit that you fucked up, you realize it, and you have taken steps (as the paperwork proves) to correct your problem.

This will go a LOOOONNNGGGG way towards helping your case, that and if you were polite to the cop ask him to vouch for the fact that you were not rude and/or causing a disturbance with your personal conduct.

I've never gotten a DUI (got pulled over in NC when I was 20, drunk as a skunk, being military helped with the ticket, being a sailor and a martial artist helped pass the field test) but I have gotten my fair share of tickets/reckless tickets.

My brother and sister both got DUIs. Sister got out of hers entirely with a good lawyer, but she paid goooooooooooooooooooooooood money.
